重慶作為國際商事爭議仲裁地的優勢
重慶是中國中西部地區唯一的直轄市,西部大開發重要戰略支點,“一帶一路”和長江經濟帶重要聯結點,內陸開放高地,在中國國家區域發展和對外開放格局中具有重要而獨特的地位。作為中國西部唯一集水陸空運輸方式為一體的綜合交通樞紐,已建成“三環十二射多聯線”高速公路網和“一樞紐十干線”鐵路網,以長江黃金水道、中歐班列(重慶)鐵路聯運大通道、中新互聯互通南向通道等為支撐的“一江兩翼三洋”國際貿易大通道已基本形成。截至2017年底,中新互聯互通項目實現跨境融資20.6億美元,簽約項目50.7億美元,中歐班列累計開行663班。來渝投資的世界500強企業已達281家。重慶經濟增長勢頭強勁,2017年GDP達1.95萬億元,上升至全國第5位,同比增長9.3%,進出口總值增長8.99%,旅游外匯收入19.4億美元,增速排名全國第一。
重慶社會治理法治化水平和社會治理體系值得信賴。重慶市人民政府重視并支持仲裁事業發展,于1996年成立重慶仲裁委員會,至今已22年,建立了具有公正高效的仲裁機制和靈活的調解機制等多元化糾紛解決保障體系。截至目前,重慶仲裁委員會累計化解民商事糾紛5萬余件,受案標的額700多億元,一直名列全國前五位,深得社會各界認同。同時,重慶法律、經濟人才資源優勢明顯,坐擁西南政法大學、重慶大學、西南大學等多所高等學府,享有大量在理論界和實務界均有較高造詣的法律及經濟專家、律師、調解員等專業人士,能夠用多種語言進行交流,為當事人提供專業優質的法律服務。

中國(重慶)自由貿易試驗區仲裁中心
中國(重慶)自由貿易試驗區仲裁中心系重慶仲裁委員會設立于重慶自由貿易試驗區的專門機構。為自由貿易試驗區企業提供仲裁法律宣傳、培訓和咨詢服務,以專業化、國際化的審理模式開展仲裁、調解等活動,依法解決自貿試驗區內商事糾紛。建立自貿試驗區多元化解矛盾糾紛解決機制,為自貿試驗區企業提供法治保障,積極營造自貿試驗區法治化、國際化、便利化安商營商環境。
——獨立公正的仲裁機制。中心引入國際商事仲裁先進制度獨立運作;建立國際化、專業化、現代化的仲裁服務機制。中心辦理案件不受其他單位或者個人的干預,獨立行使仲裁權,以確保仲裁活動的公平公正、高效便捷、保密廉潔。
——專業化的仲裁隊伍。中心選聘的仲裁員道德品行良好、國際化程度高,在涉外法律或者國際貿易、投資、海事、知識產權等領域擁有豐富的從業經驗和較高的公信力;中心仲裁秘書均畢業于國內外知名院校,具備扎實的法律功底和卓越的綜合素質,精通多門外語,可為不同國家和地區的當事人提供高效優質專業的仲裁服務。
——靈活便捷的仲裁程序。中心充分尊重當事人的自主選擇權,當事人可以選擇本中心仲裁員名冊和其他仲裁機構仲裁員名冊內的仲裁員;當事人協商一致可以選擇仲裁規則,仲裁適用的法律、語言、證據規則、開庭地點、仲裁庭組成方式等符合自己特殊需要的仲裁程序,充分運用現代仲裁程序的靈活性和便捷性,促進爭議解決。
——廣泛承認和執行的仲裁裁決。中國為1958年聯合國《承認及執行外國仲裁裁決公約》締約國,目前該公約締約國已達156個,幾乎覆蓋所有國際商事活動相對活躍的國家,中心作出的裁決可依照公約規定在上述國家得到承認和執行。
——經濟合理的仲裁成本。中心按照國際慣例確定了可供當事人選擇的多種收費方式,相對其他國際和國內仲裁機構更為靈活,費用更加合理。并且由于仲裁一裁終局、程序便捷等特點,使得當事人選擇仲裁解決爭議相對訴訟而言更為經濟。

Chongqing - Advantages of it as a Place of Arbitration for International Commercial Disputes
 
Chongqing, the only municipality directly under the Central Government in the mid-west China, is an important stronghold for the western development strategy, a vital link between the “Belt and Road” and the Yangtze River Economic Belt, and an inland open highland, playing an important and unique role in China’s national regional development and the framework of opening up. As the only integrated transportation hub combining water, land and air transportation in western China, Chongqing has now built up the “three-ring, twelve-line, multi-link” highway network and the “one hub and ten trunk lines” railway network, basically forming the “one river, two-wing, three-ocean” international trade routes supported by the Yangtze River Golden Waterway, the China-EU Railway (Chongqing) and the China-Singapore Interconnection Southbound Channel. As of the end of 2017, the China-Singapore Interconnection & Interworking Demonstration project has achieved cross-border financing of USD2.06 billion, contract volume of USD5.07 billion, and China-EU trains with an accumulative number of 663 runs. The number of Fortune 500 companies that have invested in Chongqing has reached 281. It can thus be seen that Chongqing’s economy is growing rapidly with great vigour. In 2017, its GDP has reached RMB1.95 trillion, rising to the fifth rank in China, with a year-on-year growth of 9.3%; its total value of imports and exports increased by 8.99%; its foreign exchange income of tourism was up to USD1.94 billion. The growth rate of Chongqing ranked the first in China.
 
The level of social governance legalization and social governance system in Chongqing are trustworthy. The Chongqing Municipal People’s Government has attached great importance and render support to the development of arbitration, and has established China Chongqing Arbitration Commission since 1996 which over the past 22 years since its establishment has built up a diversified dispute resolution guarantee system with a fair and efficient arbitration mechanism and a flexible mediation mechanism. Up to now, China Chongqing Arbitration Commission has solved more than 50,000 civil and commercial disputes, involving a worth of more than RMB70 billion, the figure of which made it keep ranking among the top five in China and won recognition from all walks of life. At the same time, Chongqing has outstanding advantages in terms of legal and economic talent resources. With many institutions of higher education including, among others, Southwest University of Political Science and Law, Chongqing University, Southwest University located therein, it has a large number of legal and economic experts, lawyers, mediators and other professionals who have high attainments in both theoretical and practical fields and can communicate in multiple languages, so as to provide professional and high-quality legal services to parties.
 
China (Chongqing) Pilot Free Trade Zone
 
China (Chongqing) Pilot Free Trade Zone was established on March 15, 2017 in Chongqing’s regional free trade zones with the official approval by the Central People’s Government of China. Its implementation scope has been up to 119.98 square kilometers, covering three areas of Liangjiang, Xiyong and Guoyuangang.
 
Chongqing Pilot Free Trade Zone has launched more than 100 innovative initiatives, attracting more than 10,000 newly registered companies therein. Based on the implementation of the link between the “Belt and Road” and the Yangtze River Economic Belt as well as the important stronghold for the western development strategy, it strives to build a comprehensive pilot zone of investment, trade and financial settlement, a pioneer zone of reform system integration and an open platform development zone, and to build an inland international logistics hub focusing on multimodal transport, an inland international trade center based on trade in goods, a modern financial center through promoting financial settlement facilitation, a modern service operation center aiming at interconnection and interoperability, and a key modern manufacturing base of the country supported by technological innovation.
 
China (Chongqing) Pilot Free Trade Zone Arbitration Center
 
China (Chongqing) Pilot Free Trade Zone Arbitration Center is a specialized institution established by China Chongqing Arbitration Commission in China (Chongqing) Pilot Free Trade Zone, providing arbitration legal propaganda, training and consulting services for enterprises in that zone, and conducting arbitration, mediation and other activities in a professional and international trial mode to resolve commercial disputes therein according to law. By establishing a diversified dispute resolution mechanism for the Pilot Free Trade Zone, it also provides legal protection for enterprises in the zone and actively creates a legalized, international and convenient business environment therein.
 
Independent and Impartial Arbitration Mechanism. The Center has introduced the advanced system of international commercial arbitration for independent operation to establish an international, professional and modern arbitration service mechanism. It independently exercises arbitration rights to handle cases without intervention of other units or individuals, thus ensuring arbitration activities are fair, equitable, efficient, convenient, confidential and incorruptible.
 
Professional Arbitration Team. The arbitrators selected by the Center are of good morality and are highly internationalized, with rich experience and high credibility in foreign-related laws or international trade, investment, maritime affairs, intellectual property and other fields. The secretaries of the Center are all graduates from well-known schools at home or abroad with comprehensive knowledge of law and excellent overall quality, who are proficient in many foreign languages and can provide efficient and high-quality professional arbitration services for parties from different countries and regions.
 
Flexible and Convenient Arbitration Procedures. The Center fully respects the parties’ right to choose, where the parties may choose the arbitrators from the panel of arbitrators of either the Center or other arbitration institutions, and may choose the arbitration rules, applicable laws, languages, rules of evidence, arbitration places, formation of arbitration tribunal and other arbitral procedures that meet their special needs, making the best use of the flexibility and convenience of modern arbitration procedures to promote dispute resolution.
 
Economical and Rational Arbitration Costs. The Center, in accordance with international practice, has set a variety of charging methods that can be selected by the parties, with a charging mode that is more flexible and cost-effective than other international and domestic arbitration institutions. Besides, characterized by final and binding as well as convenient procedures, arbitration is a more economical way than litigation for parties to resolve disputes.
 
Widely Recognized and Enforced Arbitral Awards. China is a party to the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards in 1958 which up to the present has 156 contracting parties from almost all countries that are relatively active in international commercial affairs. The awards made by the Center can be recognized and enforced in the above-mentioned countries in accordance with the provisions of the Convention.
